Client D. M. was charged with Possession of CDSA and Possession for the Purpose of Trafficking. On a tip from a Confidential Informant, it was alleged that D.M. was trafficking controlled substances within the Peel Region. Based on this tip, D.M. was arrested and subsequently charged. Upon review of the file, it appeared as though certain procedures were not followed by both the arresting and transporting officers. There appeared to be violations of Section 7, 8, 9, 10a and 10b Rights guaranteed by the Canadian Charter of Rights and Freedoms. As a result, on the morning of trial, the Crown decided not to proceed and all charges were withdrawn. No conviction.
