Client K.S. was charged with Robbery (domestic), Uttering Threats to Cause Death and Assault with a Weapon. The victim in this case is the accused’s mother. It was alleged that client K.S. approached the victim and demanded $40. When the victim refused to provide K.S, with $40, K.S. threatened to kill the victim. The accused then grabbed a large meat cleaver and began waiving it towards the victim. K.S. then held the large knife to the victim’s throat, again making demands for the money. Due to the extensive criminal history of the accused, which spans across the past eighteen years, as well as the aggravating circumstances surrounding the allegations, the Crown Attorney was seeking a custodial sentence in excess of three years, to be served in a federal penitentiary. After a Judicial Pre- Trial, the Crown Attorney was not willing to renegotiate their position on the charges. After a two- day Gardiner Hearing was set, Mr. Batasar furthered discussions with the Crown Attorney, highlighting the victim’s willingness to reconcile with the accused. Prior to the Hearing taking place, Mr. Batasar was able to successful argue K.S.’s case by having his potential sentenced reduced to only 4 and a half months custody.
