Client B.C. was charged with Excess Blood Alcohol. It was alleged that after being stopped by police for a Highway Traffic Act offence, the officer formed the opinion that B.C. was operating a motor vehicle while intoxicated. After failing a registered screening device, B.C. was arrested. Suitable samples of his breath were taken by a breath technician at the police station, and it was evidence that B.C.’s blood alcohol levels were above legal limits to be operating a motor vehicle. After numerous discussions with the Crown Attorney, Mr. Batasar was able to have B.C.’s criminal charge withdrawn. No criminal conviction.
