Client C.D. was charged with Assault, Assault with a Weapon, Administering a Noxious Substance, and Obstruct Police. It was alleged that client C.D. and the victim met up for the purpose of a consensual, mutual sexual exchange. Proceeding this alleged exchange, an argument began over the disposal of the used contraceptive. The accused proceed to then spray the victim in the face with dog repellent. A physical altercation ensued and the accused bit the victim’s wrist. It was the accused’s position that all of the sexual acts that took place were non- consensual. After mounting a vigorous defence, Mr. Batasar was able to prove that there was no wrongdoing on the part of the accused, thus rendering C.D. innocent of all charges. All charges were withdrawn; no conviction, no criminal record.
