Clients R.B. and T.B were each charged with Aggravated Assault. It was alleged that the two individuals felt threatened by the victim due to ongoing disputes between the parties. On the date of the incident, clients R.B. and T.B. alleged that they were attacked by the victim and acting on impulse, attacked the victim in self-defence. The victim in this case received substantial injuries as a result of this altercation, including a punctured lung, and was admitted to hospital in the intensive care unit for treatment. Once in court, the Crown Attorney advised counsel that there was a possibility that these charges would be upgraded to Attempted Murder, which carried a sentence of at least five years imprisonment if found guilty. Acting swiftly, Mr. Batasar reviewed the merits and weaknesses of this case and discussed them at length with the Crown Attorney. It was determined that this matter would be most appropriately resolved by way of a Common Law Peace Bond. As such, both and R.B. and T.B. entered into a Peace Bond and their charges were withdrawn.
