Client M.K. was charged with one count of Domestic Assault, and two counts of Breach of Probation. It was alleged that after a dispute regarding their relationship, M.K. became enraged when the victim indicated the desire to end their relationship. Enraged at this, the accused proceeded to hit the victim over the face. This argument moved to the kitchen where the accused continued to strike the victim numerous times. This violent dispute occurred in the presence of their young child. Once in court, the Crown Attorney was seeking a 6 month custodial sentence upon resolution of this case. This matter was subsequently set down for trial, and discussions continued between Mr. Batasar and the Crown Attorney. Prior to the commencement of the trial, Mr. Batasar was able to have the Crown agree in his view that there was little probability of conviction after trial, given the strength of the victim’s statement to police immediately after the incident took place. As such, all charges were withdrawn prior to trial. No conviction, no criminal record.
