Client G.D. was charged with Impaired Operation of a Motor Vehicle and Excess Blood Alcohol. It was alleged that the accused had driven a vehicle to a local bar and upon exiting the vehicle, was approached by police who formed the suspicion that this individual had been operating a motor vehicle while under the influence of alcohol and was subsequently arrested. Despite numerous requests for full disclosure, the Crown was unable to provide a specific item pertinent to the proper defence of the accused. Over a year had passed and the Crown was still unable to provide disclosure item and as a result, Mr. Batasar was able to have all charges withdrawn the morning of trial. All charges withdrawn, no conviction, no criminal record.
