Client H.T. was charged with Assault Cause Bodily Harm, Assault with A Weapon and Uttering Threats to Cause Death or Bodily Harm. It was alleged that after the accused attended victim’s place of residence to discuss their relationship, the accused grabbed the victim’s phone and repeatedly struck the victim in the face with a hair dryer. After the victim called the police, the accused threatened the victim, then fled the scene. The Crown in this case was seeking a 12-18 month jail sentence for the accused given the aggravating circumstances of the case, coupled with the injuries sustained by the victim. After the Judge heard counsel’s sentencing submissions and reasons why the court should be lenient on his client, the Judge wholeheartedly agreed with Mr. Batasar’s position and did not hand down a custodial sentence. Client was released from jail that afternoon.
