The Client N.N. was charged with four counts of Assault. It was alleged that the accused became involved in a verbal argument with the victim inside their place of residence in the presence of children. The verbal argument continued outside and it was alleged that the accused was walking back to his place of business when the accused turned around and slapped the victim across the face. The victim returned to the vehicle and contacted the police. It was alleged that the accused then drove away and later located the victim during which time the accused placed both hands around the victim’s neck and lifted the individual off of the ground for several seconds. The accused let go of the victim and fled the scene and was subsequently charged.
Prior to being represented by Mr. Batasar, the accused has been represented by a different lawyer for the same charges. At the time that Mr. Batasar took carriage of the case, the matter was already set down for a Superior Court trial and the Crown Attorney was seeking a 12 to 18 month jail sentence upon conviction. After numerous Judicial Pre- Trials and discussions with the Crown Attorney, Mr. Batasar was successful in returning the matter to the Ontario Court of Justice and resolving the charges for no jail and no criminal conviction, thus sparing the accused an immediate loss of professional accreditation in his pursuit of becoming a police officer.
