Client C.M. was charged with Assault, Assault with a Weapon, Assault causing Bodily Harm, Uttering Threats x2, Forcible Confinement and Overcoming Resistance. Client C.M. had been in a tumultuous relationship with the victim for the past six years; they share one child together. It was claimed that C.M. was involved in the sex trade industry and had solicited both the victim and a witness to the offence. It was alleged that one evening, the accused demanded sexual favors from the victim, of which the victim declined. A verbal argument ensured and it was alleged the accused grabbed the victim by the shirt and proceeded to continuously bang the victim’s head against a pole. It was alleged that the accused then proceeded to throw a bottle of alcohol at the victim. A physical altercation ensued, during which the accused allegedly threw the victim to the floor and began choking the victim, as well as threatened to kill the victim if police we called. As a result of the altercation, the victim sustained soreness to the head and the right side of their body Due to the aggravating circumstances of the allegations, and the fact that a witness alleged to have observed the entire incident, the Crown Attorney was seeking in excess of 15 months custody for a resolution of the case. Mr. Batasar worked aggressively and fought vigorously for client C.M. The case required extensive review of disclosure and numerous discussions with the Crown Attorney. A Preliminary Hearing was set and prior to proceeding with the hearing, Mr. Batasar was able to have ALL CHARGES WITHDRAWN except for a simple assault; client received a conditional discharge. No jail, NO CONVICTION ON ALL CHARGES.
