Client G.D was charged with Assault. It was alleged that on July 19, 2016, the victim was in the basement residence and at approximately 11:05 am the accused returned home from work after finding out the victim was not going to work and engaged in an argument which continued into the bathroom. While in the bathroom it was alleged that the client G.D placed his hands on the victim’s neck pushing her against the bathroom wall. It was also alleged that the victim’s head was struck two to three times and did not suffer major injuries.
After mounting a vigorous defence and discussing at lengths with the Milton Crown Attorney, Mr. Batasar brought to light the insufficient evidence in the Crown’s case to proceed with the charges and was able to have all charges against the accused withdrawn; no conviction, no criminal record which in turn saved the client from a loss of professional accreditation and can move forward with his life.
