Client K.M was charged with two counts of Assault and one count of Uttering Threats. The accused has been in a relationship with the victim for the past 3 years and lives with the victim’s children from prior relationships. It was alleged that the accused got into a heated argument regarding finances and pushed their 18 month old child on the ground. It was alleged the client K.M pushed the victim onto the couch, grabbed her cell phone out of her hand and scratching her in the process. It was also alleged that K.M picked up a weapon and threated the life of the victim. Despite the victim’s affidavit stating her exaggerations on the alleged charges and mental health issues, Mr. Batasar fought hard for his client, bringing to the forefront of inconsistencies in the victim’s affidavit as well with other weaknesses in the Crown’s case.
As a result, Mr. Batasar was successful in having all charges against the accused withdrawn with a Peace Bond Order allowing the accused to keep the peace with the victim, sparing the accused’s relationship with the children and with the victim.
