Client K.N. was charged with one count of Breach of Conditional Sentence. One of K.N.’s conditions was to remain in the residence unless granted written permission to leave. It was alleged that while serving the Conditional Sentence in the community, and without being granted prior permission to leave the residence, client K.N. attended a local passport office and attempted to apply for a Canadian passport. It was later discovered that he attempted to do so, thus breaching the Conditional Sentence K.N. was currently serving. After numerous discussions with the Crown Attorney, Mr. Batasar was able to have the Judge agree to not proceed on the Breach charge and have client K.N. placed back on the Conditional Sentence. NO CONVICTION.
