Client R.S was charged with Excess Blood Alcohol. R.S was on her way home from a friend’s house in Brampton. The client was driving home in a brown Honda Civic Friday December 18th, 2015 at 1:35pm and was investigated after the client conducted a U-Turn at a ride spot check at Bovaird Drive and Heritage Road.
Peel Regional Police pulled R.S over and upon investigation she admitted to consuming alcohol as the officer noted an odour of alcohol on the client’s breath and noted her eyes were red rimmed and watery. The officer gave the client the approved screening device demand and provided a suitable sample which registered as a “fail.” The officer read her rights to counsel and caution and demanded a breath sample.
The client was arrested for excess blood alcohol and then transported to 21 Division. R.S was faced with a qualified breath technician and gave two breath samples that indicated readings of alcohol in her blood.
Mr. Batasar brought forward many inconsistencies in the case and after numerous discussions with the Crown Attorney, and Mr. Batasar was able to get the to drop all impaired and excess blood charges to a lesser charge of Careless driving. With this result the client was able to keep her license, Avoid a Criminal Record, and Conviction.
