Client S.S was arrested for Impaired Operation of a Motor Vehicle and Excess Blood Alcohol. The client was travelling Southbound in a Honda Civic on Sunday November 29th, 2015 from a family gathering earlier that night.
The client was observed to be driving a with a ruptured front passenger side tire. The client was approaching the intersection of Hurontario Street at Ray Lawson when the traffic signal changed to red. It was alleged that the client was observed proceeding through the intersection against the red light and as a result the client was stopped by the police.
Upon further investigation by Peel Regional Police, it was noted that the client had bloodshot watery eyes, difficulty forming coherent sentences, and noticed a strong odour of an alcoholic beverage emanating from the client’s breath. The police formed an opinion that the client’s ability to operate a motor vehicle was impaired by alcohol and the accused was arrested for impaired operation. Upon arriving at the police station S.S conducted a breathalyser test which indicated results of 239 milligrams of alcohol in 100 millilitres of blood and was advised of her second charge.
Mr. Batasar conducted lengthy Crown Pre Trial meetings with the Crown Attorney and brought forth many inconsistencies involving the conduct of the officers, and brought forth an argument which rendered the Crown to agree, based on merits of the case, to drop all charges for a lesser charge of Careless Driving. This in turn saved the client from a Criminal Conviction and no loss of her license. The client was extremely happy with this outcome and is able to move forward with her career with No Criminal Record.
