A Brampton man was sentenced to 36 months in jail after pleading guilty to child pornography and assault charges.
John Brian Wyton, 51, of McMurchy Ave. was sentenced yesterday. Justice Bruce Duncan recommended he serve his time at the Ontario Institute of Corrections (OCI) in Brampton where treatment programs are available.
No psychiatric or psychological evidence was put before the court, though it would seem obvious from the facts that the accused has an unnatural interest and attraction to adolescent boys” Duncan wrote in his decision.
OCI is known for its programs dealing with sexual deviance.
Wyton was given a credit of 16 months for the 8 months he has already served in pre-trial custody, bringing the remainder of his sentence to 20 months. He was also sentenced to 3 years probation. Wyton pleaded guilty to seven criminal charges last months- making child pornography, sexual touching of male under fourteen years, indecent assault, assault causing bodily harm, and three drug possession charges.
He was arrested by Peel Regional Police last September. At the time, 800 videotapes were seized, but it was later discovered that only one or two had to do with a criminal offence.
One of the videotapes made by Wyton showed six or seven boys under 18 years of age engaged in masturbation, and mutual masturbation with Wyton.
Court heard some of the boys were offered drugs before sex acts.
The Crown had asked for six years in jail, while Wyton’s defence lawyer Gary Batasar, had asked for “time served.”
Batasar said Wyton is relieved his case has been dealt with.
“He hopes that the can get some benefit out of OCI,” Batasar said.
“He’s relieved that it’s over and glad he didn’t have to put anybody through the process of having to testify in court and relive any of the traumatic experiences.”
